April 1897 Kevin Lock kalock@iinet.net.au An Escaped Prisoner.- George Thompson, the prisoner who escaped from Constable Bailey in such a sensational manner some weeks ago by jumping out of a train, was placed in the dock on a charge of having illegally escaped from custody. Thompson stated that he jumped out of the window of the carriage he was in because the officer he was in charge of was asleep and a splendid opportunity to regain his liberty thus presented itself to him. The accused was sentenced to six months imprisonment with hard labour cumulative upon the term of twelve months he was originally sentenced to at Kalgoorlie. See site: http://www.nla.gov.au/ferg/issn/14403676.html] MAITLAND CIRCUIT COURT This court opened on Monday, 7th March, before his Honor Mr. Justice THERRY. A. CARTER, esq., officiated as Clerk of Arraigns, and Major CRUMMER, P.M., as Deputy Sherrif. The barristers present were the Attorney General, who prosecuted on behalf of the crown, W. A. PUREFOY, esq., - MURRAY, Esq., and - FAUCETT, Esq. STEALING GOLD DUST John SHEPHERD, alias George RILEY, was indicted for stealing sixty ounces of gold dust, and one valise, the property of Richard Lewis JENKINS, at Nundle, on the 4th June, 1852. The witnesses called were Richard Lewis JENKINS, Thomas DAVIS [8 years old], William MCLENNAN, James EAMES, John POWNALL, Thomas BROOKS, and John Valentine GORMAN. Other names mentioned are SPENCER, GRADY, William DAVIS (Thomas's father] Guilty; 5 years on the roads. Thomas DAVIS (8 years old!) charged with perjury. ABDUCTION Thomas HICKEY was indicted for the abduction of Elizabeth CALDWELL, an unmarried girl of fifteen years, from the custody and without the consent of her father, Samuel CALDWELL, [Innkeeper, Walcha] on the 14th December, 1852 at New England. Witnesses called were Samuel CALDWELL, and Elizabeth CALDWELL. Not guilty. Her father couldn't prove she was under 16. UTTERING FORGERIES Robert WATT was indicted for uttering 3 small forged orders, at Hinton, on 12th December, 1852, with intent to defraud. The witnesses called were William NEWMAN [Innkeeper] and John CHRISTIAN, junior [Innkeepers landlord]. Guilty. WATT was then charged with a second offence of uttering a forged order in the amount of 5s. A witness, Alfred NEWMAN, in addition to the two above was called. Guilty. 3 years on the road for each offence (i.e. total of 6 years). OBTAINING A HORSE ON FALSE PRETENCES Hugh MCCULLAH, alias Alexander MCCULLAH, was indicted for obtaining a horse from James MCCORMACK, at Upper Paterson, on the 1st February, 1853, on the false pretences that he had a station, and had funds in the Bank of Australasia, Maitland, on which he gave a cheque in payment for the horse. The witnesses called were James MCCORMACK, and George BEESTON [Clerk, Bank of Australasia. Other names mentioned are Dr. DOBIE, Mr. DURBIN (Clevedon estate). MCCULLAH's defence was that he had no recollection of the transaction or of Mr. MCCORMACK; some considerable time since he was kicked in the head by a horse, and in consequence was frequently insane; he was confined in Tarban Creek Lunatic Asylum for a considerable time. Guilty; 5 years on the roads. HORSE STEALING William IRELAND, alias William KEEN, alias BRUMMY, was indicted for stealing one mare, the property of William ELBURGH, at Peel River, on 1st January, 1853. The witnesses called were William ELBURGH [Blacksmith, Tamworth], John FALKNER [Keeper Moonboy Inn, 14 miles beyond Tamworth], Stephen DOYLE and Patrick DUAN [Constable]. Other name mentioned: Mrs. GARDNER. Guilty; 5 years on the roads. STEALING OR RECEIVING George PEARCE was indicted for stealing sixty ounces of gold, the property of Richard Lewis JENKINS, at Peel's River, on 4th June, 1852. In a second count he was indicted for feloniously receiving the gold. The witnesses called were Richard Lewis JENKINS, John POWNALL, William CAMERON, Thomas BROOKS, John MCGIVNEY [Chief Constable], George WOOD [Constable], and Joseph ECKFORD [Innkeeper, Maitland]. This case is an "extension" of the first case mentioned above. PEARCE was employed by Dr. JENKINS to find the valise and gold. He did so, but kept the gold. Other names mentioned: Mr. Donald MCINTYRE, Blairmore (50 or 60 miles from Nundle) Guilty: 5 years on the road. Maurice & Jean Bath, Blenheim, NZ mebath@ihug.co.nz The full text can be seen at: http://www.ncc.nsw.gov.au/library/locals/textarchive/merewet.htm The only disaster of any magnitude was caused by a fall, which occurred on Saturday, June 22, 1889, in the Hamilton Pit of the A.A. Company, so named after Edward Terrick HAMILTON, the first Governor of the Co., 1856-1898. This pit, though not in the municipal area, was only a short distance from the northern boundary, just off Alworth Street, and the workings which collapsed were within the area, the depression being visible in the land known as Myers' farm, in Merewether west, part of which land is now used as golf links. In the report of the Inspector of Collieries it is noted that eleven men and boys lost their lives, the following being "killed by a fall or crush of roof in crosscut district," Jabez ROBERTS, David PROCTOR, John PEATE, senr., John PEATE, jnr., Daniel MASSON, Thomas BANFIELD, Herbert PETTIT, whilst John MEADOWS, George BEAUMONT, Alex. GRANT, James HODSON "died from being entombed in the cross-cut district." Ten of these were residents of Merewether. Saturday, June 22, was the day for the change of cavil, that is, the quarterly draw for fresh places, and the miners were engaged in removing their tools from their old bords to their new places. At about 9 o'clock many of them had reached their bords, and others were having breakfast. Almost without warning a great fall took place and some of the men and boys were immediately buried. There was a number of narrow escapes, and some of the survivors were brought to the surface in a bad way. Rescue parties were at once formed but they were beaten back, as the roof was still "working," and they were forced to heavily timber every inch of the way. At 8 p.m. there was little hope of getting anyone out alive, and at 9 a.m. on Sunday all hopes were given up. Strenuous times were encountered by the rescue party, the whole of whom took their lives in their hands, and it can be best conceived by men used to clearing fallen ground in a pit, when I say that the fall was so extensive and the roof so crushed that only four or five yards per full shift could be cleared and timbered On Monday, July 1, the roof was still working and the rescue party were in danger. So great was the risk that they had to leave the working face for fear they would be entombed. During this particular time .they were only able to drive and timber seven feet, in twelve hours. The first body, that of Herbert Pettit, was found and brought to the surface on July 2, this being ten days after the disaster took place. On July 4, it was decided-by the management of the Company that the work would be abandoned owing to the dangerous nature of the work, and the difficulty in driving through the unsettled debris, but the men continued work on the next day, and soon came to a fairly open space, when the heavy breathing of an animal was heard, and soon the party came across a pony standing upright. Steps were at once taken to get him out, his legs were securely bound and boards covered with canvas laid under him. As soon as the legs of the pony were released from the debris he laid down on the boards and was partly carried, partly dragged, over the falls. He had been twelve and a half days imprisoned, and was recognised by the hostler, William ARTWOOD, as "Sharpo". . (At) the spot where "Sharpo" was found . there was a crack in the roof from which there was a trickle of water. This was constantly dripping on to his foreleg. By licking his leg he was able to satisfy his thirst, though he had not eaten anything for the whole period of his imprisonment. Soon after his release "Sharpo" died. and he was skinned and stuffed, being exhibited in various parts of the city and district. Whilst this rescue was going on the roof was "going off" like thunder, and after a long consultation it was decided, reluctantly to, abandon work. It was then decided by the Government that they would attempt to get out the rest of the bodies, and, after advertisements had been inserted in the various papers calling for volunteers, the following were chosen for the work: Facemen, George LACEY, James McLUCKIE, John LACEY, Randolph BALDYAN (sic), Henry CHAMBERS, Richard HARDY, John HITCHCOCK, David INGLIS, George SHAW, Joeetch (sic) MACNAY, George HERRON, John SUMMERS, John CART, John WALLWORK, Thomas HITCHCOCK, William B. GRIFFITHS, John WRIGHTSON; John ROB-SON (sic), John ALLAN, Charles DAWES. Timber-cutters, Roger COOK, John MARSH. Surfacemen: Fred THOMPSON, John PRICE. Patrol: Wm. JENKINS, W. ARTHUR, Win. HUMPHREYSs. Wheelers: Enoch JACKSON, John GRAHAM, Frank DARCEY, N. NELSON. The manager was A. BURNS and the clerk A. E. HALL. These men were to work in four shifts of six hours each for which the Government would pay, and all plant, including everything wanted, would be supplied by the A.A. Company. On July 16, work was commenced by the Government rescue party, and on August 3, the bodies of Thomas Banfield and John Peate, junr., were found; on August 11 Daniel Masson and John Peate, senr on August 25 Jabez Roberts; on September 3 James Hodson, George Beaumont, John Meadows and Alex. Grant. The search for the last body, that of Proctor, was abandoned on September 5, because, in the supposed position where the body would be found, there was a great deal of water and the work would be extremely dangerous. The Government rescue party prosecuted the search for two days without remuneration, but the manager did not think it advisable to continue as the A.A. Company would be commencing to draw coal from a section nearby, during the following week, and further search would then take place. Before finally abandoning that part of the mine a further search was made by the Company and on September 8 the body of David Proctor was found. The whole of the rescue work undertaken by the Government was under the direct supervision of Collieries Inspector John DIXON. MARRIED At Christ Church, Newcastle, on the 26th November, by the Rev. C. P. N. WILTON, M. A. , Mr. John HANDERSON, to Miss Susannah Mary DYER, both of Newcastle, and eldest daughter of Mr. William Calvin DYER, of Morpeth. DEATHS At Tenana Creek, Wide Bay, on the 5th instant, having been cruelly murdered by the blacks, Mr. George FURBER, for many years a resident of the Hunter River District, aged 44 years, deeply regretted by a large circle of his friends. At the same time and place, Mr. Joseph WELMSHURST, aged 28 years, who met his death in like manner, and son-in-law of the above, leaving a wife and one child, with many friends, who deplore his untimely end.
